Privacy Policy

Valley Toyota Dealers Association, Inc. (“us,” “we” and “our”) and our authorized Toyota dealer members (“Dealers”) are committed to maintaining your confidence and trust as it relates to the privacy of your information. Please read below to learn how we and the Dealers collect, protect, share, and use your information as part of our technology platforms, including the website at phoenix.buyatoyota.com (“Site”), our other websites, interactive features, applications, Facebook, YouTube, other social media networks and mobile applications (collectively, “Platforms”). The Site is a subdomain of buyatoyota.com (“Primary Domain”), which is administered by Toyota Motor Sales, U.S.A, Inc. (“Toyota”). We manage the content of the Site and, as of the date of this Privacy Policy, the Site is administered by Five & Done, LLC.

1.                 Information Collected by Toyota

Toyota gathers information (“Toyota-Collected Information”) through this Site and the Primary Domain that you may provide (like your name, address, telephone number, e-mail address, or other personally identifiable information) or that may be collected automatically (like internet traffic information). All Toyota-Collected Information is subject to, and treated in accordance with, Toyota’s separate privacy policy (“Toyota Privacy Policy”). The Toyota Privacy Policy is available online here: http://www.toyota.com/support/privacy.htmlIn addition to identifying the information that Toyota may collect through this Site and the Primary Domain, the Toyota Privacy Policy explains how the Toyota-Collected Information is used, who the Toyota-Collected Information is shared with, and other information regarding the Toyota-Collected Information.

2.           Information Collected by US

We use pixel tags to measure internet traffic on the Platforms. Pixel tags are transparent images, sometimes called a web beacon or tracking beacon, that are placed on a web page to gather information about when and how often a web page has been viewed (“Pixel-Tag Information”). A pixel tag may also tell your browser to get content from another server. Pixel tags assist in collecting your IP address or other unique identifier (“Device Identifier”) for the device (computer, mobile phone, tablet, or other device) you use to access the Platforms. A Device Identifier is a number that is assigned to your device when you access a website or its servers, and our computers identify your device by its Device Identifier. 

3.           how we use information we collect

We and the Dealers use the information we collect or are given about and from you for a variety of business purposes. For example, it may be used to respond to your questions and requests for product information, new vehicle information alerts, and brochures; to advise you of important safety-related information; to enable you to participate in promotional activities or other programs; to verify your identity; to communicate with you; to tailor content, advertisements, and offers we or the Dealers serve you; to improve the Platforms; to comply with license obligations; and for any other purposes disclosed at the time you provide any personally identifiable information or otherwise consent or as permitted or required by law. We may use a Device Identifier to, among other things, administer the Platforms, help diagnose problems with our servers, analyze trends, track users’ web page movements, help identify you and your shopping cart, and gather broad demographic information for aggregate use.

4.           Sharing of information

Toyota may share the Toyota-Collected Information with Dealers and third parties as described more fully in the Toyota Privacy Policy. We may share Pixel-Tag Information with other third parties that perform functions on our behalf such as: service providers that host or operate all or part of the Platforms, analyze data, process transactions and payments, fulfill orders, or provide customer service; advertisers; and sponsors or other third parties that provide marketing or promotional assistance. Pixel-Tag Information is generally used solely by us, but may be shared with Toyota and Dealers. Summary reports of aggregate data from Pixel-Tag Information are occasionally shared with Dealers. If you choose to receive e-mails about products and other information, your personal information may be provided to Toyota and one or more Dealers.

We may transfer and disclose information collected through the Platform to third parties to comply with a legal obligation; when we believe in good faith that the law or a governmental authority requires it; to verify or enforce any other applicable policies; to address fraud, security, or technical issues; to respond to an emergency; or otherwise to protect our rights or property or the security of third parties, visitors to the Platform, or the public.

Some browsers have a “do-not-track” feature that informs a website that the user does not want to have the user’s online activities tracked. These features are not yet uniform, so we are not currently set up to respond to those signals.

We may receive information about you from third parties. We may supplement the information we or the Dealers collect about you through the Platforms with such information from third parties in order to enhance our ability to serve you, to tailor our content to you, and/or to offer you opportunities to purchase products or services that we believe may be of interest to you.

6.           your privacy rights, choice, and access

The Platforms give you choices. For example, you may decide to submit personal information through the Platforms. If you choose to submit any information through the Platforms, or otherwise exercise any discretion while visiting or using the Platforms, we will strive within our control to keep your information updated and accurate. In accordance with our routine record keeping, we may delete certain records that contain information you have submitted through the Platforms. We are under no obligation to store such information indefinitely and disclaim any liability arising out of, or related to, the destruction of such information. If you would like us to remove your information from our databases, please contact us using a contact method provided in this Privacy Policy. It may not always be possible to completely remove or delete all of your information from our databases without some residual data because of backups and other reasons. We will retain and use your information (including geo-location data) as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. We do not control certain privacy settings and preferences maintained by social media sites like Facebook and YouTube. If you wish to make changes to those settings and preferences you may do so by visiting the settings page of the appropriate social media site. We may not have access to your personal information provided to Toyota and the Dealers; therefore, if you would like to update or delete such information you will need to contact the Dealers and/or Toyota directly.

7.        ADVERTISING/BEHAVIORAL TARGETING; HOW TO OPT-OUT

We may use third party ad network providers to help present ads on the Platforms, as well as other service providers to evaluate and provide us with information about the use of the Platforms and viewing of our content. Personal information may be shared with these providers when you complete forms on the Platforms or when you give us permission to share your personal information. Such providers may place and access cookies, pixel tags, or similar technologies on your device to serve you ads or other content personalized to your interests which they infer from your precise location and/or your browsing on the Platforms and other websites you have visited. In doing so, the provider collects or has access to non-personal information such as your usage information. The use of cookies, pixel tags, or similar technologies by these providers is subject to their own privacy policies, not ours.

If you prefer to not receive targeted advertising, you can opt-out of some network advertising programs that may use your information. To do so, please visit the DAA Opt-Out Page. Please note that even if you choose to remove your information (opt-out), you will still see advertisements while you’re browsing online. However the advertisements you see may be less relevant to you and your interests. Additionally, many network advertising programs allow you to view and manage the interest categories they have compiled from your online browsing activities. These interest categories help determine the types of targeted advertisements you may receive. The DAA Opt-Out Page provides a tool that identifies its member companies that have cookies on your browser and provides links to those companies. In addition, certain advertisements may provide links to allow you to opt-out of targeted advertising or programs from their network.

8.           Children

The Platforms are not directed to children under 13. We do not knowingly collect, use, or disclose personally identifiable information from anyone under 13 years of age. If we determine upon collection that a user is under this age, we will not use or maintain his/her personal information without the parent/guardian’s consent. If we become aware that we have unknowingly collected personally identifiable information from a child under the age of 13, we will make reasonable efforts to delete such information from our records.

9.           Security of Your Information

We take information security seriously and use certain reasonable security measures to help protect your personal information. However, no electronic data transmission or storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure or warrant the security of any information you transmit to us, and you use the Platforms and provide us with your information at your own risk. WE WILL NOT BE RESPONSIBLE FOR ANY HARM THAT YOU OR ANY PERSON MAY SUFFER AS A RESULT OF A BREACH OF CONFIDENTIALITY IN RESPECT TO YOUR USE OF THE PLATFORMS OR ANY INFORMATION YOU TRANSMIT TO THE PLATFORMS.

10.           Other WEBSites

The Platforms may contain links to other websites that we do not own or operate, as well as links from advertisers, sponsors, and/or partners. We do not control, recommend, or endorse and are not responsible for these websites or their content, products, services, or privacy policies or practices, even though they may use our name or logo on their website through an agreement with us. These other websites may send their own cookies to your device, they may independently collect data or solicit personal information, and may or may not have their own published privacy policies. You should also independently assess the authenticity of any website which appears or claims that it is related to us or our Platforms (including those linked to through an email or social networking page).

11.       CONSENT TO PROCESSING AND TRANSFER OF INFORMATION

The Platforms are governed by and operated in, and in accordance with the laws of, the State of Arizona. Given that Toyota is an international business and conducts business with international businesses, its use of your information may involve the transmission of data on an international basis. If you are located in the European Union, Canada, or elsewhere outside of the United States, please be aware that information we, Toyota or a Dealer collect may be transferred to and processed in the United States. By using or visiting the Platforms, or providing us with any information, you (a) acknowledge that the Platforms are subject to the laws of the State of Arizona, (b) consent to the collection, processing, maintenance, and transfer of such information in and to the United States and other applicable territories in which the privacy laws may not be as comprehensive as or equivalent to those in the country where you reside and/or are a citizen, and (c) waive any claims that may arise under those laws.

12.          YOUR CALIFORNIA PRIVACY RIGHTS

If you are a California resident, under California’s "Shine the Light" law, you are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. To obtain this information from us please contact us using a contact method provided in this Privacy Policy with "Request for California Privacy Information" in the subject line and in the body of your message.

If you are a California resident under the age of 18, and a registered user of the Site, California Business and Professions Code Section 22581 permits you to request and obtain removal of content or information you have publicly posted. To make such a request, please send a letter with a detailed description of the specific content or information to the address provided below in Section 14 with "Request for California Minor Information Removal" in the subject line and in the body of your message. Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have submitted or posted and that there may be circumstances in which the law does not require or allow removal even if requested.

We may update this privacy policy to reflect changes to our information practices. If we make any material changes we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on the Site prior to the change becoming effective. While we try to make sure that all prices posted here are accurate at all times, we are not responsible for typographical and other errors that may appear on the website. If the posted price for a vehicle or service is incorrect due to typographical or other error (e.g., data transmission), the participating Dealer is responsible only for the correct price, which they will endeavor to provide to you as soon as they become aware of the error. We make every effort to provide you the most accurate, up-to-the-minute information. However, it is your responsibility to verify with the Dealer that all details listed are accurate. Vehicle images and descriptions posted on our website pages are the representations provided by our suppliers. Please note that actual vehicle may differ slightly from specifications and/or images. Participating Dealers are not responsible for typographical, pricing, product information, advertising or shipping errors. Advertised prices and available quantities are subject to change without notice. In the event a vehicle is listed at an incorrect price due to typographical, photographic, or technical error or error in pricing information received from our suppliers, Dealer shall have the right to refuse or cancel any orders placed for any vehicle listed at the incorrect price.
